SMS Terms of Service

These SMS Terms of Service ("SMS Terms") govern text messages sent through the ClearPath platform on behalf of subscribing automotive repair shops ("Shops"). By providing your mobile phone number to a participating Shop and consenting at the point of service, you agree to these SMS Terms.

1. Program Name

ClearPath OS Customer Service Notifications.

2. Program Description

Participating automotive repair shops use the ClearPath platform to send transactional text messages to their existing customers regarding active vehicle service. Messages relate to a specific service interaction the customer initiated with the Shop. ClearPath sends these messages on behalf of the Shop; the Shop is the sender of record and identifies itself by name in every message.

3. Message Types

Customers who opt in may receive the following types of transactional text messages from a participating Shop:

  • Appointment reminders
  • Vehicle-ready and service-completion notifications
  • Recommended or declined service follow-ups from prior visits
  • Post-service review requests
  • Service-related questions and authorization requests during an active repair

Messages are transactional in nature and tied to the customer's relationship with the Shop. Marketing or promotional messages are not sent under this program.

4. How to Opt In

Customers opt in to receive SMS messages from a participating Shop in person at the Shop, during the vehicle service intake process. The Shop's service advisor records the customer's mobile phone number on the Shop's service intake form (printed or digital). Adjacent to the phone number field, the intake form contains the following written SMS disclosure, which the customer signs to authorize the service work:

The customer's signature on the intake form constitutes express written consent to receive the SMS messages described above. Consent to receive SMS is not a condition of purchasing any goods or services from the Shop.

5. Message Frequency

Message frequency varies based on the customer's active service interactions with the Shop. Typically fewer than four (4) messages per month per active service. Customers receiving multiple concurrent services or multi-vehicle service may receive a higher volume.

6. Message and Data Rates

Msg & data rates may apply. Standard message and data rates from your wireless carrier may apply to each message sent or received. ClearPath and the participating Shop are not responsible for any carrier charges incurred. Contact your wireless carrier for details about your specific plan and any applicable rates.

7. Help

For help, reply HELP to any message you receive from a participating Shop, or contact ClearPath support at info@driveclearpath.com. For service-specific questions, contact the Shop directly using the phone number in the message.

8. Opt Out

  • You may opt out of SMS messages from a participating Shop at any time by replying STOP to any message you receive from that Shop.
  • Upon receiving a STOP request, ClearPath will send a one-time confirmation message acknowledging the opt-out, after which no further messages will be sent to that number from that Shop.
  • To resume messages after opting out, reply START at any time, or re-enroll in person at the Shop.
  • Other accepted opt-out keywords: STOP, END, CANCEL, UNSUBSCRIBE, QUIT.

9. Carriers

Supported carriers include AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, Cricket, MetroPCS, U.S. Cellular, Virgin Mobile, and most other U.S. mobile carriers. Carriers are not liable for delayed or undelivered messages.

10. Privacy

ClearPath does not share, sell, rent, or otherwise disclose mobile phone numbers, SMS opt-in information, or any consent-related data with third parties or affiliates for marketing or promotional purposes. Phone numbers and SMS data are used solely to deliver the transactional messages described in these SMS Terms on behalf of the Shop the customer has a direct service relationship with.

11. Sender Information

  • Messages are sent from the participating Shop's designated phone number and identify the Shop by name in the message body.
  • ClearPath maintains opt-out lists on behalf of each Shop. A STOP request to one Shop does not opt the customer out of messages from a different participating Shop the customer has a separate service relationship with.
  • ClearPath complies with the Telephone Consumer Protection Act (TCPA), CTIA messaging guidelines, carrier requirements, and all applicable federal and state regulations governing business-initiated SMS communications.

12. Eligibility

The SMS program is available to customers in the United States who are 18 years of age or older and who have a direct service relationship with a participating Shop. By opting in, you represent that you meet these eligibility requirements and that the mobile number you provide belongs to you.

13. Changes to These SMS Terms

ClearPath may update these SMS Terms as the program evolves or as required by law, carrier guidelines, or industry standards. Material changes will be reflected by updating the "Last updated" date at the top of this page. Continued enrollment in the SMS program after a change indicates acceptance of the updated SMS Terms.
